Patrons Terms & Conditions

Thank you for supporting us by joining our Patrons Scheme. This webpage sets out the terms and conditions of your membership. You should read it carefully as it sets out your rights and obligations as a Patron of Mall Galleries.

Please note that acceptance of your application and receipt of your Fee by Mall Galleries creates a valid and legally binding contract between you and Mall Galleries, which is governed by these terms and conditions. References in these terms and conditions to “Mall Galleries”, “we” or “us” are references to Mall Galleries and / or the Federation of British Artists as applicable. These terms and conditions also apply to donations and gifts.

1 Definitions

1.1 In these terms and conditions, the following words have the following meanings:

Federation of British Artists means the charity registered at 17 Carlton House Terrace, London SW1Y 5BD (registration number 200048);

Fee means the money you have paid to Mall Galleries to become a Patron and for the benefits set out in accordance with your chosen level of patronage. It does not include any sum given as a discretionary donation;

Patron means you and/ or any other member of  Mall Galleries Patrons Scheme (depending on the context in which it is used). Please note that these terms and conditions apply to all Patrons;

Patron Card means the card or cards provided to you by Mall Galleries confirming that you are a Patron;

Patron Period means the date from which Mall Galleries receives your Fee to the date on which your membership of the Patrons Scheme expires. The term of your Patron Period is set out on your Patron Card.

 

2 Your Patrons Scheme Benefits

2.1 As a Patron of Mall Galleries you are entitled to:

2.1.1 a Patron Card(s);

2.1.2 unlimited access for you and 3 guests to all exhibitions;

2.1.3 complimentary catalogue for all exhibitions;

2.1.4 invitations to private views, opening parties, talks and other events;

2.1.5 invitation to the annual Patrons dinner;

2.1.6 visits to artists’ studios and private collections;

2.1.7 our biannual printed Exhibitions Guide and a quarterly e-bulletin;

2.1.8 offers from third parties;

2.1.9 acknowledgement of your support on Mall Galleries’ Donors Board (unless otherwise requested);

2.1.10 opportunity to nominate an organisation for a Mall Galleries learning course (Gold Patrons);

2.1.11 private tour of Mall Galleries with an artist / curator (Gold & Platinum Patrons);

2.1.12 one annual visit of your choice for a private exhibition tour outside opening hours (Gold and Platinum Patrons);

2.1.13 education workshop provided by Mall Galleries’ Education Department for a school, charity or community organisation of your choice (Platinum Patrons only);

2.1.14 10% off event hire for your own private event in Mall Galleries (Platinum Patrons only).

2.2 We reserve the right to change the benefits that apply to the Patrons Scheme at any time and without prior notice. Where possible, changes to benefits will be published on our website.

2.3 Any third parties or external providers of a benefit included in the Patrons Scheme benefits package will have absolute discretion in relation to that benefit and that benefit will be subject to the provider’s own terms and conditions.

 

3 Your details

3.1 During your time as a Patron we will collect information about you to personalise your experience of the Patrons Scheme. We collect information about you in a variety of ways including, but not limited to:

3.1.1 when you join as a Patron;

3.1.2 each time you use your Patron Card(s) to visit exhibitions;

3.1.3 when you make bookings for events;

3.1.4 when you make a purchase in the bookshop in galleries and online;

3.1.5 when you create online user accounts;

3.1.6 when you respond to our emails.

3.2 All information that you provide to Mall Galleries will be processed and held in accordance with all current data protection legislation and our privacy policy.

3.3 You agree that personal details provided to Mall Galleries may be used for administrative purposes to fulfil your membership rights and provide membership services to you. In some cases we work with external suppliers to provide certain services. All data is transferred securely and all external suppliers have signed data processing and confidentiality agreements with us. Your personal details may also be used for marketing, statistical and analytical purposes and we will, provided you have consented to us doing so, use your contact details to let you know about our events, exhibitions and fundraising appeals.

3.4 You are responsible for informing us of changes to your personal details. Please do not share your individual passwords for access to our on-line services with anyone else. You may instruct us to provide you with any personal information which we hold about you, by contacting us in writing at the address set out in clause 3.7 below. Please let us know if any personal information which we hold about you needs to be corrected or updated.

3.5 We do not collect or process sensitive personal data such as race, ethnic origin, physical or mental health, political or philosophical views or sexual orientation.

3.6 Subject to clause 3.3 we will never sell, rent or exchange your details with any other organisation outside of Mall Galleries / the Federation of British Artists. 

3.7 You may opt-out of communications from us at any time, although they form part of your Patrons Scheme benefits. 4 Subscription fees for benefits and payment

4.1 All Patrons will pay an annual Fee for benefits. We reserve the right in our absolute discretion to change the Fee each year. Silver Plus Patrons will pay for three years with the Fee for benefits reduced by 10%.

4.2 Your membership of the Patrons Scheme is valid immediately from the day that your Fee is received by us in cleared funds and will usually be valid for 12 months unless, for example you have joined as a Silver Plus Patron. If you do not renew, your membership of the Patrons Scheme will expire automatically at the end of the Patron Period unless it is renewed in accordance with clauses 4.4 or 4.5 below. 

4.3 Upon expiry of your membership of the Patrons Scheme you will no longer be a Patron and you will no longer be entitled to receive any Patrons Scheme benefits.

4.4 Renewal by Direct Debit: When each Patron Period comes to an end, we will send you a renewal reminder. If you do not wish to renew you must inform us at the earliest opportunity and preferably at least 10 days before the end of your Patron Period.

4.5 Renewal by cash, cheque, and credit/debit card: When each Patron Period comes to an end, we will send you a renewal reminder, and your membership of the Patrons Scheme will be cancelled unless and until a further Fee payment is received from you within 30 days.

4.6 In order to comply with HMRC guidelines, we are not able to accept CAF cheques as payment for membership of the Patrons Scheme.

4.7 We reserve the right in our sole discretion to terminate your membership of the Patrons Scheme if in our reasonable opinion you behave in a way which is considered to be harassing, causing distress or inconvenience to other Patrons, any visitor to Mall Galleries, any member of our staff or any director, trustee, Friend, donor or other supporter of Mall Galleries or the Federation of British Artists or you breach any of these terms and conditions.

4.8 Subject to any statutory right to cancel, your Fee is non-refundable once payment has been received by us.

4.9 Patron’s rights are not transferrable and Patrons are not permitted to allow another person to use their Patron Card.

4.10 Patron’s rights shall cease on a Patron’s death or on an individual ceasing to be a Patron. 

4.11 If a Patron made a discretionary donation in addition to paying the Fee for benefits, that donation is eligible for Gift Aid and thus can be included in self-assessment tax returns. Gift Aid can only be claimed where a Patron completed a valid Gift Aid declaration. It is your responsibility to read the declaration and truthfully fill it out. It is also your responsibility to inform us of any changes in your tax status, if your name and/or address changes or if you wish to cancel the declaration. You have 30 days to cancel the Gift Aid declaration after receiving acknowledgement from Mall Galleries before any claim is submitted against the donation. To be eligible for Gift Aid, a donor has to be a UK taxpayer and to have paid an amount of UK income tax or capital gains tax that is equal to any tax we would reclaim on your donation. Declarations are valid into the future until you notify us that it needs to be stopped.

 

5 Publications and other materials

5.1 Unless stated otherwise, copyright and all other rights in all publications and materials supplied to you by Mall Galleries and / the Federation of British Artists is owned by Mall Galleries / the Federation of British Artists. Patrons may not reproduce, transmit, distribute, sell or commercially exploit these materials without our prior written consent or to the extent expressly permitted by law.

 

 

6 Liability

6.1 Subject to clause 6.3, and to the extent possible by law, we exclude all liability to Patrons or to any other third party for any loss of profit, or any special, incidental or consequential damages (however arising, including negligence) arising out of, or in connection with services, benefits and/or products supplied by us.

6.2 Subject to clause 6.3, our liability to you is limited to the amount of your Fee.

6.3 Nothing in these terms and conditions excludes liability for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation.

This may be an acknowledgement of receipt while further investigations are carried out.

 

8 General

8.1 The failure of or delay by us to exercise or enforce any right in these terms does not constitute a waiver of such rights.

8.2 We reserve the right to amend these terms and conditions in our absolute discretion at any time upon reasonable notice to you.

8.3 These terms and conditions shall be governed by and interpreted in accordance with English law and, in the event of any dispute arising out of these terms and conditions and/ or your membership of the Patrons Scheme, you agree with us to submit to the exclusive jurisdiction of the English courts.
